1.Basis Of Fees

I can supply details of the hourly rates and minimum charges which may apply to any particular type of transaction on request as part of my Notary Public Terms of Business, all of these rates are subject to review from time to time. Although my fees are assessed primarily on the basis of the time spent on a matter, my fees may also reflect other factors such as the value or importance of the transaction. In all cases my fees will be fair and reasonable.

Any estimate of fees is given in good faith on the basis of the information which is available at that time; it will not, however, be binding.

2. Payment And Invoices

I reserve the right to ask for money to be paid on account to fund my fees and/or expenses which I will incur on your behalf. Normally my invoice is to be paid prior to my releasing the completed documentation. Any invoice which remains unpaid 7 days after completion will be subject to a charge for interest from the due date at 4% above the base rate from time to time of the Royal Bank of Scotland.

3. Money Laundering Compliance

I operate a money laundering procedure as required by law. If I have any suspicions, information will be revealed to the appropriate authorities. You will be required to provide satisfactory proof of identity and you may also have to supply full details of the source and the proposed destination of any funds.

4. Data Protection Act

Details of my clients and matter references will be stored on computer for archive and retrieval purposes. I may also use this information to mail client communications from either my notarial practice or the practice of Wortley Byers LLP.

5. Jurisdiction

English law shall be the applicable law and the English courts will have exclusive jurisdiction in the case of any dispute.

6. Wortley Byers LLP Solicitors

I am a partner in the separate law practice of Wortley Byers LLP. In accordance with the guidelines which apply to notarial practices, any client referred by me to that solicitors’ practice does not have any of the protection which attaches to the client of a notary, but does benefit from the practice rules which apply to a solicitors’ practice. The Wortley Byers LLP terms of business will apply in such a case and these terms are available on demand.
